By accessing or using our website, placing an order, or entering into a dealer relationship with us, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Shipping Policy, and Return Policy. If you do not agree, please do not use our services.

3. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our services. By agreeing to these Terms, you represent that you meet these requirements and have legal capacity to enter into binding contracts.

4. Product Descriptions & Specifications

We strive to provide accurate product descriptions, measurements, specifications, and imagery. However:

Screen-rendered colors may differ slightly from actual fabric colors due to monitor calibration variation
Fabric samples are strongly recommended before larger orders
Product specifications may be updated without notice to improve quality
All measurements are subject to standard manufacturing tolerance of ±3mm

5. Orders & Contract Formation

Your order constitutes an offer to purchase. A binding contract is formed only when we issue an order confirmation email or, for wholesale orders, a signed proforma invoice.

We reserve the right to decline any order, at our discretion, for reasons including but not limited to:

Product unavailability or material shortage
Errors in pricing or product information
Concerns regarding payment authorization or fraud
Inability to ship to the specified address
Order suspicion or legal compliance concerns

6. Pricing & Payment

All prices shown on our website are exclusive of taxes, shipping, and import duties unless otherwise stated
Retail prices displayed are in the currency selected by the user; wholesale prices are confirmed via proforma invoice
We reserve the right to change prices at any time without notice, but changes will not affect confirmed orders
Accepted payment methods: credit card, bank wire transfer, Letter of Credit (wholesale), PayPal (retail only)
Payment must be received before production begins, unless agreed credit terms are in place (Platinum dealers only)

7. Custom-Made Products

All Ibiza Premium Shades products are custom-made to order. Once production begins, orders cannot be cancelled unless authorized by us in writing. Buyers are responsible for providing accurate measurements. Please refer to our Refund Policy for details on acceptable returns.

8. Intellectual Property

All content on ibizapremiumshades.com — including logos, photographs, product designs, text, graphics, and compilations — is the property of İBZE Kardeşler San. ve Tic. Ltd. Şti. or its licensors, and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from our content without prior written permission, except for:

Personal, non-commercial use of product photography for your own home installation
Authorized dealers using our brand assets pursuant to a Dealer Agreement

9. User Accounts

If you create an account on our website or dealer portal:

You are responsible for maintaining the confidentiality of your password
You are responsible for all activity under your account

10. Prohibited Conduct

You agree not to:

Attempt to gain unauthorized access to our systems or other users' accounts

Our total liability for any claim relating to a product shall not exceed the purchase price paid for that product

We are not liable for delays or failures caused by events beyond our reasonable control (force majeure)
Product installation is the responsibility of the buyer or their contractor; we are not liable for damages resulting from improper installation

For transactions with İBZE Kardeşler (Turkey): Laws of the Republic of Turkey. Any disputes shall be submitted to the courts of Antalya, Turkey, unless otherwise agreed in a separate Dealer Agreement.
For international commercial disputes above USD 50,000: Arbitration under the ICC Rules of Arbitration, seat: İstanbul, language: English, may be specified in the Dealer Agreement.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Cookie Policy, and (for dealers) the Dealer Agreement, constitute the entire agreement between you and Ibiza Premium Shades regarding our services.
